YOUR CONTRACT WITH ROCKSTAR 


TERMS & CONDITIONS

These Terms and Conditions apply to the Reservation (defined below). In order to make a Reservation, We expect You (defined below) to read through these Terms and Conditions carefully. If You do not agree to these Terms and Conditions, You may not make a Reservation.

1. DEFINITIONS In these Terms and Conditions, the following words shall have the meaning set opposite:- “Conditions” means these Terms and Conditions;

“Deposit” means £500 or 40% (whichever is the greater) of the Price per person unless we have agreed an alternative Instalment plan for your group.

“Itinerary” means a personalised schedule produced by Us for You, containing a Package based on Your requirements;

“Package” means the pre-arranged combination of at least two of the following components when sold or offered for sale at an inclusive price and which service covers a period of more than 24 hours or includes overnight accommodation:- (a) transport; (b) accommodation; (c) other tourist services not ancillary to transport or accommodation and accounting for a significant proportion of the Package;

“Personal Information” means the information provided by You on creating an Itinerary or making a Reservation including Your name, address, contact details and payment details;

“Price” means the total price paid per person for the Itinerary; “Reservation” means the securing of the Itinerary when the Deposit has been paid within 5 days of receiving your finalised Itinerary;

“Service Provider” means any other party other than Us, who will provide services for the Itinerary including, but not limited to accommodation, transport and golf passes; “Start Date” means the date upon which the Itinerary commences;

“We/Us/Our” means Rockstar Golf Tours (Scotland) LTD, a company registered under the Companies Acts (Registered Number: SC553287) having its registered address at 101 Rose Street South Lane, Edinburgh EH2 3JG.

‘You’ means the person who has completed the online booking form and each and every member of the group on whose behalf the Group Contact has signed. If the booking form is signed on behalf of a limited company and that is clear on the booking form, “You” means that company. If we accept a booking by telephone or by the Internet ‘You’ means the person making the booking.

Once your initial deposit has been paid.  Your booking will be confirmed but will be subject to all the additional Instalments being paid on time as outlined in this arrangement.AS WE NEED TO MATCH THE TERMS AND CONDITIONS OF OUR SUPPLIERS.  ALL DEPOSITS MADE TOWARDS GOLF AND ACCOMMODATIONS ARE NON-REFUNDABLE UNLESS ONE OF THE PROVISIONS BELOW APPLY.

The Group Contact is obliged to pay us all monies due under this agreement, this is, of course, subject to the cancellation terms set out below. If other members of the group decide not to proceed or claim a refund or if we agree to accept payments from them or if their credit card company grants them a refund, the Group Contact remains liable. We will credit any payments received from individuals towards the group booking price against the Group Contacts obligations.

WHEN?
No binding agreement will be in place until we receive a non-refundable deposit as detailed on our invoice.

WHAT?
Rockstar Golf Tours organise VIP Turnkey Golf experiences using the very best suppliers, Golf Courses and accommodations.in Scotland.

RISK – Our Responsibility?
Through our agents, we organise a wide variety of events. Some of them involve a degree of risk to you of physical injury or damage to property. We do not accept liability for the negligence of any other persons.

In order to reduce risk, the following conditions will apply –
Our agents reserve the right to withdraw you from an event if you do not honour your behaviour obligations or are not in their opinion fit enough to participate (see the section below ‘What Do You Agree To Do’) Occasionally our suppliers may (because of the risky nature of an event) may require you to sign a disclaimer releasing them from liability for loss suffered in the course of an event. We will not be liable for any loss you may suffer if you fail to sign such disclaimer whether such loss occurs under this agreement or otherwise.

RISK – Your Responsibility?
Our agents do all they reasonably can to reduce all risks to you.  Some events and activities can require a good level of fitness strength and endurance and it is your responsibility to ensure that you have the appropriate level.

If any member of your group is under eighteen or has any existing medical condition which may affect their ability to participate fully in an event. You must let us know

WHAT DO YOU AGREE TO DO?
” To behave at all times in a safe and courteous manner.
” To obey the proper instructions of any supervisor or leader.
” To dress and equip yourself suitably for the weather etc

DAMAGES
Any damage caused by the lead person or any of the participants of  an activity, accommodation or event will be charged directly to the lead person. This will include any intentional damage or damage arising from unreasonable behaviour to suppliers’ equipment, machinery, furnishings (including accommodation hotels and apartments) and public areas within the facilities booked by you. The management of our suppliers has the right to refuse ongoing services or entry to their premises to any individual whose behaviour is in their sole opinion inappropriate.
All persons attending an event organised by RockStar Golf are responsible for organising their own insurance covering the risk of participation in the event or activity. We ask that all participants are fully and adequately insured.

WHAT HAPPENS IF YOU WANT TO CANCEL?
Cancellation costs us money and there needs to be an agreed cancellation policy. You and we agree with the following:

COVID CANCELLATION OF YOUR TRIP

In the event of your golf, accommodations, Transport or any other element of your trip being cancelled the trip would be rebooked for a future date.

As a result, in the event of a date change, we will immediately guarantee your Package for the new dates.  If you are not able to attend the revised dates we would only consider a refund on the basis that we are able to resell your package to the same number of persons.  If we are unable to do this a refund would not be made.

WHAT ABOUT MONEY?
A deposit of 50% of the total booking value is payable by bank Transfer when you confirm your booking. The remainder of the total booking value is payable no later than 15 January 2021.
If you do not pay us within the time limits that we specify you may jeopardise our ability to provide the event and we have the right to provide alternatives to all or part of the original booking. If the full payment is not received by the time specified, we have the right to treat all or part of the booking as cancelled and you will be liable for the cancellation charges due to us under this agreement.

CAN WE CHANGE WHAT WE AGREED TO PROVIDE
Yes within limits. We reserve the right to change accommodation to other accommodations of similar quality with similar access to any activities that we agree to arrange. If an event within a package, which we organise, becomes unavailable for reasons beyond our control, we will have the choice of organising an alternative activity (in consultation with you) or making a proportional refund. If we decide that such an event is a subsidiary and not a principal part of any package, we will not be obliged and you will not be entitled to cancel the whole package.

FORCE MAJEURE
We will not, together with Our Service Providers, be liable for injury, damage, loss, accident, delay, irregularity, changes or inconvenience caused by, but not limited to, the following: any force majeure health risks, reasons of war, the threat of war, riots, civil strife, terrorist activity, or expense to personal property due to act or default of any hotel, carrier or any other company or person providing or rendering of the Itinerary.

We will not, together with the Service Providers, accept responsibility for any sickness, pilferage, labour disputes, machinery breakdown, government restraints, weather condition, defect in any vehicle or transportation or for any misadventure or casualty or any other causes beyond Our control.

AGREEMENT
We think that the above terms and conditions are fair. Now that you have read them, please follow the Digital Signature Process. This automatically advises Rockstar Golf Tours that you have understood and agreed to our booking conditions. If you wish to book by telephone or via the Internet it is understood that you have read and accepted Rockstars Terms and Conditions.
